You cannot legally take a remodeling contract in the five boroughs without a Home Improvement Contractor license from the Department of Consumer and Worker Protection. DCWP writes that a business must hold one to do 'construction, repair, remodeling, or other home improvement work' on any residential building here. And you must either post a $20,000 surety bond or enroll in the DCWP Trust Fund. Unlicensed work risks fines and voided contracts.
The Landmarks Commission Reviews Your Facade
If your project sits in one of New York's historic districts, the Landmarks Preservation Commission reviews it before the work starts. LPC states plainly that 'most exterior changes to the front and rear facades of buildings in historic districts require review by LPC.' So new windows, a stoop, or a rooftop addition on a designated block need a Certificate of Appropriateness or a minor-work permit first. Build that timeline into your schedule.
DOB Ties Your Permit To Your License
New York's Department of Buildings ties your permit to your license. When you file an Alteration 1, 2, or 3 application, the DOB says the contractor 'must submit their Home Improvement Contractor (HIC) license and number when obtaining a permit.' On the PW2 form, section 6 asks whether the work needs an HIC license, and the clerk validates your card. So a kitchen gut or a bath reconfiguration cannot pull a permit without a valid HIC on file.
New York's ADU Rules Stay Narrow
Do not oversell backyard cottages to your New York clients. The city only legalized accessory dwelling units in December 2024 through Local Laws 126 and 127 and the City of Yes amendment, and the rules are narrow. DOB allows one ADU per one- or two-family home, capped at 800 square feet, with a separate entrance. But backyard ADUs are banned in historic districts, and subgrade units are barred from FEMA flood areas.
New York Files The Most
New York leads the country in website accessibility filings, and the state offers plaintiffs more than the federal ADA does. The New York State and City Human Rights Laws let a plaintiff collect compensatory damages with no statutory cap, plus attorney fees. And you do not need an office in New York to get sued, because serving New York residents online is enough. So a contractor marketing into the metro is exposed.
State Court Is The New Venue
Plaintiffs have shifted many New York cases into state court, where the Human Rights Law rules and damages run friendlier to them. And the city law adds civil penalties that can climb into six figures for willful conduct. Most defendants settle rather than test it. So if your booking form or gallery fails a screen reader, a New York filing is a quick and cheap move for the other side.
Fake Reviews Are Now Illegal
The FTC's Rule on Consumer Reviews and Testimonials took effect on October 21, 2024, and it targets exactly the shortcuts contractors get tempted to take. You cannot buy reviews, write them as the owner without disclosing it, or post testimonials from people who never hired you. And the FTC can seek civil penalties of up to $53,088 per violation. So that glowing five-star wall needs to be real and disclosed.
